- drink driving
Michael has been studying and analysing Victoria’s drink
driving legislation since the early 1980s. He has completed numerous
courses in traffic alcohol law and has completed the Victoria
Police breath analysis course.
Michael prides himself on having an extensive & up to date
knowledge on all drink driving issues, loopholes and upcoming
legislation changes.
If your offence is a first time drink driving offence and the
police have issued you with a traffic infringement notice for
a blood alcohol reading of 0.070% or above, there is little that
a court can do. Under current law, it is mandatory that your
licence be cancelled.
Drink driving is a serious charge and Victoria has some of the
strictest drink driving laws in Australia. If you are charged
with a second or subsequent drink driving offence, or a first
time offence with a very high reading, please contact this office
urgently.
The Victorian laws on drinking and driving are now tougher then
ever before. The Road safety Act 1986 states that for a second
drink driving offence, a court can cancel your licence indefinitely,
impose heavy fines up to $6000.00 or send you to jail for up
to 6 months. If your second offence is higher than 0.150 %, then
a Court can fine you up to $12,000, and send you to jail for
maximum period of 12 months. A third or later drink driving offence
with a reading of 0.150% or more can now attract up to $19,000
or up to 18 months imprisonment. It is important to get legal
advice promptly, as there are always jail alternatives a court
can consider.
I understand that your driver’s licence is often your
livelihood. If there is anything I can do, or any loophole I
can find, to protect you from losing your licence, I will certainly
do that!
Drink driving legislation is complex and is way too big an issue
to cover in a web site – please call Michael Kuzilny right
away if you have been charged with a drink driving related offence.
The Victorian law also states that if you drive whilst your
licence is suspended, severe jail terms can be imposed.
Take action promptly. Call Michael on 041 555 7011 or 1800 130
120 – let’s get you back on the road as soon as possible!
