Navigating Complex Inquiries with Expertise
A Royal Commission is one of the most significant forms of public inquiry in Australia, established to investigate matters of great importance and public interest. If you find yourself involved in a Royal Commission—whether as a witness, an institutional representative, or an interested party—it is crucial to have experienced legal representation. At MK Law, we have a proven track record of guiding clients through the complexities of Royal Commission hearings in Melbourne and across Victoria.
Understanding Royal Commissions:
A Royal Commission is initiated to explore, in a public forum, issues of substantial public concern. The objective is to uncover the facts surrounding specific matters, identify systemic failures, and make recommendations for future policy or legislative reforms. These inquiries can span several years and often lead to significant changes in laws and regulations.
Key Features of a Royal Commission:
- Established by Government: Either the Governor-General at the federal level or the Governor-in-Council at the state level sets up a Royal Commission.
- Broad Powers: Commissions have quasi-judicial powers, enabling them to compel attendance, testimony, and the production of documents.
- Public Proceedings: Hearings are generally open to the public, although sensitive testimonies may be heard in private.
- Outcomes: Findings can lead to policy recommendations, legislative changes, and referrals for criminal prosecutions.
Why Legal Representation is Essential:
Being involved in a Royal Commission can be daunting. The proceedings are formal, and the implications of your testimony can be significant. Legal representation ensures that your rights are protected and that you are adequately prepared for the proceedings.
Our Role as Your Legal Counsel:
- Advising on Legal Obligations and Rights: We help you understand your responsibilities, such as the requirement to answer questions, and your rights, including protections against self-incrimination.
- Preparing Written Statements: Our team assists in drafting accurate and thorough statements that reflect your recollections without unintentionally incriminating you.
- Guidance During Hearings: We provide support during oral testimonies, including cross-examinations, ensuring you are confident and composed.
- Applying for Legal Assistance Funding: If you’re concerned about legal costs, we can help you apply for funding provided by the Commonwealth Attorney-General for legal assistance in Royal Commissions.
Frequently Asked Questions
- How is a Royal Commission Established?
A Royal Commission is set up by the government to investigate matters of national or state importance. It is established under specific legislation, such as the Royal Commissions Act 1902 (Cth) at the federal level or the Constitution Act 1975 (Vic) and the Evidence (Miscellaneous Provisions) Act 1958 (Vic) in Victoria. The Commission operates under defined terms of reference, outlining the scope and objectives of the inquiry.
- Can I Be Compelled to Answer Questions?
Yes, you can be compelled to answer questions and produce documents, even if the information may incriminate you. However, protections are in place:
- Use Immunity: Generally, your testimony cannot be used against you in future criminal proceedings.
- Exceptions: If you are already charged with an offence related to the inquiry, you may refuse to answer questions that could impact your case.
- Legal Guidance: We ensure you understand these nuances and help protect your rights during the process.
- What If I Can’t Afford a Lawyer?
Legal representation is crucial, and financial constraints shouldn’t prevent you from accessing it. The Commonwealth Attorney-General’s Department often provides funding for legal assistance in Royal Commissions. We can assist you in applying for this funding to ensure you receive the support you need.

He took the time to truly understand my situation and represented me with professionalism, compassion, and confidence in the Magistrates Court. Daniel didn’t just handle the legal side—he supported me as a person, not just a case file, and clearly explained every step so I always felt informed and prepared. The outcome he achieved reflected both his skill and commitment. If you need a lawyer who genuinely cares, communicates clearly, and fights hard for the best result, I strongly recommend Daniel and the team at MK Law. Read Less55/5

Read MoreDaniel Moon was my lawyer for my driving offences, and he was the best one I had, he achieved the best outcome for my case. However, I wouldn’t personally recommend the law firm itself. Before I was assigned to Daniel, my case was passed around between 4–5 different lawyers, the process was messy, and communication was very poor. Some of the lawyers they gave me were unprepared, wasted my time, and one of them didn’t even have a valid practising licence, which led to an adjournment. That said, I do recommend Daniel (the lawyer!) who is currently with the firm, and Marie, the first lawyer who was assigned to me who is no longer with the firm. Read Less55/5
