Section 53C of the Crimes Act (“CA”) deals with causing another person to provide commercial sexual services under circumstances involving sexual servitude. The offence criminalises situations where a person (A) causes or induces another person (B) to provide or continue providing sexual services when B is not free to stop due to certain coercive or manipulative actions by A or a third party (C).
The circumstances that render ‘B’ unable to stop providing sexual services can involve:

What must the prosecution Prove:
To secure a conviction under Section 53C, the prosecution must prove each element beyond a reasonable doubt:
- That ‘A’ caused or induced ‘B’ to provide, or continue providing, commercial sexual services.
This could involve any active conduct by ‘A’ that leads ‘B’ to engage in or continue such services.
- B was not free to stop providing sexual services or to leave the place where the services were provided. This lack of freedom must be due to one or more of the following:
- Use of force against ‘B’ or another person (D).
- Threats made to or against ‘B’ or another person (D).
- Unlawful detention of ‘B’ or ‘D’.
- Fraud or misrepresentation directed toward ‘B’ or ‘D’.
- Exploitation of debt that is manifestly excessive or purportedly owed by ‘B’ or ‘D’.
3. ‘A’ knew or was aware that their conduct, or the actions of another person (C), would probably result in ‘B’ being coerced into continuing to provide commercial sexual services or being unable to leave.
What is Sexual Servitude?
The definition of sexual servitude generally refers to a condition in which a person is forced or coerced into providing sexual services under circumstances that deprive them of their freedom. This lack of freedom can arise from threats, violence, fraud, exploitation of vulnerabilities, or manipulation, making it impossible for the person to leave or refuse to provide those services.
More specifically, in legal contexts, sexual servitude often includes situations where:
- The person is not free to stop providing sexual services.
- The person is not free to leave the place or area where the sexual services are provided.
- Coercion is used, which may involve:
- Force or violence.
- Threats to the individual or someone else.
- Unlawful detention.
- Deception or fraud.
- Exploiting an excessive debt.
