What does it mean to be charged with Possession of Tablet Press?
Under Section 71C of the Drugs, Poisons and Controlled Substances Act 1981 (Vic) (“DPCSA”), it is an indictable offence to possess a tablet press without lawful authorisation or excuse.
What is a Tablet Press?
A tablet press is a machine used to compress powdered substances into tablets, commonly associated with the production of illicit drugs like ecstasy or other illegal substances.
What must the prosecution prove?
- You had actual or constructive possession of the tablet press, meaning they either physically have it or have control over it (e.g., stored in a place you own or control).
- You were not licensed or authorised by law to possess the tablet press.
Penalties for being in Possession of a Tablet Press:
Level 6 imprisonment which accounts to 6 years, and/or a maximum of 600 penalty units being a sum of money determined by the court.
