What Does It Mean to Be Charged with an Offence Under Section 5AA?
Under Section 5AA of the Control of Weapons Act 1990 (“CWA”), it is an offence to possess, use, or carry a prohibited weapon (other than an imitation firearm) without an exemption under Section 8B or an approval under Section 8C.
What Does the Prosecution Have to Prove?
To secure a conviction under Section 5AA of the CWA, the prosecution must establish the following elements:
- You possessed, used, or carried a prohibited weapon (excluding imitation firearms).
- The weapon in question is classified as a prohibited weapon according to Schedule 2 of the Control of Weapons Regulations 2021.
Penalties for Possessing, Using, or Carrying a Prohibited Weapon:
- 240 penalty units or imprisonment for up to 2 years.
What Constitutes a Prohibited Weapon?
Prohibited weapons are items considered unsuitable for general possession or use without special approval. Examples include:
- Flick knife
- Daggers
- Knuckle knife
- Butterfly knife
- An item designed to conceal a prohibited weapon
This is a partial list. For a comprehensive list, refer to Schedule 2 of the Control of Weapons Regulations 2021 and the Control of Weapons Act 1990.
Distinguishing Controlled and Prohibited Weapons
Controlled weapons differ from prohibited weapons in that they can be possessed and used for legitimate purposes, though they may still pose a potential danger. Examples include:
- Knives not classified as prohibited weapons
- Spear guns
- Batons or cudgels
- Bayonets
- Cattle prods
Possession, carrying, or use of controlled weapons requires a lawful excuse. For a full list, see Schedule 1 of the Control of Weapons Regulations 2021.
Where Will My Case Be Heard?
Charges under Section 5AA are typically heard in the Magistrates Court. More serious cases may be escalated depending on circumstances.
Factors and Defences to Consider:
- Can the prosecution prove all required elements of the offence?
- Is the weapon classified as prohibited under Schedule 2 of the Control of Weapons Regulations 2021?
- Do you have an exemption under Section 8B or 8C of the CWA?
- What are the surrounding circumstances of your case?
