The charge under Section 53B of the Crimes Act (“CA”) Using force, threat, etc. to cause another person to provide commercial sexual services means that a person (referred to as “A”) is being accused of using various forms of coercion or manipulation to force another person (“B”) into providing or continuing to provide commercial sexual services against their will.
What must the prosecution prove?
- “A” used one or more of the following methods to exert pressure on “B” or another person:

- Force: Physical violence or threats of violence.
- Threats: Any kind of threat directed at “B” or another person, including physical harm or other forms of intimidation.
- Unlawful Detainment: Holding “B” or someone else against their will.
- Fraud or Misrepresentation: Deceiving “B” through lies, false promises, or hiding crucial information.
- Manifestly Excessive Debt: Using an overwhelming or falsely inflated debt as a means to control “B.”
- By engaging in the coercive behaviour listed above, “A” causes “B” to:

- Provide or continue to provide commercial sexual services: Forcing “B” to engage in sex work.
- Prevent “B” from leaving: “A” creates circumstances where “B” is unable or feels unable to leave the location where they provide these services.

- Intend for their actions (like threats or force) to cause “B” to continue providing sexual services or to prevent “B” from leaving the area where they provide these services.
- Know that their actions will likely result in “B” being forced to continue providing services or not being free to leave.
Penalty for forcing someone into providing commercial sexual services:
- If found guilty of this charge, “A” could face level 4 imprisonment, which carries a maximum sentence of 15 years.
